1. General remarks 

These Terms of Service (ToS) apply to all affairs between the club “St. Gallen Model United Nations”, represented by the Conference Secretariat, (henceforth “SGMUN”) and participants of the SGMUN Conference (henceforth “Conference”). The participant will be denied admission to the conference, should these ToS not be accepted. All terms herein apply to every event in connection with the conference, before, during, as well as after the conference.

2. Contractual relationship between SGMUN and the Conference participants 

SGMUN will, during the period from the 1st of December 2022 to the 4th of December 2022, act as organiser and provider of a Model United Nations conference in St. Gallen. It will try to provide a conference structure, allowing participants to simulate certain procedures of the United Nations. In exchange for the fee specified on the SGMUN 2022 Conference homepage on the mymun website, participants will be able to take part in roles assigned to them by SGMUN. 

SGMUN will try to provide accommodation and social events for participants who desire it. For further details, please refer to “5. Accommodation”. 

SGMUN reserves the right to modify the scope of its contractual obligation until the 1st of December 2022. These modifications will be communicated to participants.

Organising arrival and departure, as well as fare is within the area of responsibility of the individual participants. 

All participants must at minimum be 18 years of age on the 1st of December 2022.

3. Liability 

SGMUN cannot be held responsible for the behaviour of its participants. Participants are accountable for their own individual actions and behaviour. SGMUN is not liable for the consequences that arise from participants’ misconduct. 

SGMUN can only be held liable for claims for damages caused by gross negligence or intent, so far as it concerns SGMUN’s responsibility. SGMUN cannot be held liable for actions of or damage caused by auxiliary staff. Participants indemnify and further keep indemnified SGMUN from and against - law permitting- all liability for consequential damages. 

SGMUN assumes no responsibility for errors occurring outside of its direct area of responsibility, including but not limited to operators of lodging or transport services and providers of facilities or technical services in connection with the Conference or social events. In particular, SGMUN cannot guarantee that all activities will take place without delay or error. 

Participants indemnify and keep indemnified - law permitting - SGMUN, auxiliary staff and other aides of the Conference from and against any claims of responsibility for theft, loss or damages to participant’s private property. Any and all responsibility for the security of both the participants and their belongings lie with the participants themselves. 

All participants hereby acknowledge they have been reminded to treat any facilities they might use during their stay, including rooms and equipment provided to them by any party associated with the Conference, with adequate care and respect and to follow instructions of SGMUN and its auxiliary staff, as well as associated organisations in so far as it relates to the safety and civility of the Conference. All participants are to obey the house rules of all locations used by the Conference. SGMUN and associated parties hold no duty of supervision. 

It’s the responsibility of participants to be adequately insured during the Conference. 

4. Privacy 

Participants hereby express their consent to SGMUN making audio-visual recordings or taking photographs of them and publishing them on the Website or social media for the express purpose of marketing, documentation, reporting and advertising. Participants waive and keep waived any present or future claims for compensation or disgorgement of profits from this media or its publication and usage. 

Participants further consent to usage of their personal data (name, email address, cell phone number) for the purpose of internal organisation and communication with associated parties.

Data protection

If data related to the vaccination status of participants is collected, it will be deleted until 4 weeks after the conference and will not be used for other purposes than for the organisation of the SGMUN Conference 2022. The sole item of data regarding the Covid 19 vaccine treated and stored for organizational purposes from the certificate is the vaccination status and the vaccine type itself, due to the crucial character of this information for the organization of the SGMUN conference. Collection and processing of data concerning health is only done in order to fulfill requirements set by university or national regulations.

5. Accommodation 

SGMUN will try to provide for lodging of participants in hostels or student quarters and shared flats. Participants acknowledge that they are not entitled to any specific lodging solution and will accept the accommodation to which they are allocated. Possible changes in the overall housing situation will be handled as part of SGMUN’s entitlement to modify the scope of its contractual obligation until the 1st of December 2022. 

6. Expulsion from the Conference 

SGMUN reserves the right to reject applications and expel participants from the Conference or social events for any reason. If payment has already occurred, please refer to “7. Refund upon cancellation or expulsion” for further information. 

7. Refund upon cancellation or expulsion 

Participants, as well as SGMUN, have the right to withdraw from their contractual relationship. Withdrawal may occur as a result of cancellation on the part of the participant or SGMUN. Expulsion of a participant will result from a decision by SGMUN. 

In case of cancellation or expulsion, the following conditions determine refunds, should payment already have occurred: 

  • Full refund during the first 72 hours after registration. This condition will prevail in case of conflict with other conditions;

  • Refund of 75% of any payment received by SGMUN, if cancellation or expulsion is more than two months before the Conference;

  • Refund of 50% of any payment received by SGMUN, if cancellation or expulsion is between one and two months before the Conference;

  • No refund for cancellation or expulsion less than one month before the Conference.

In the event that the Conference is cancelled due to force majeure, SGMUN reserves the right to refrain from the conditions stated above and unilaterally adjust the reimbursement conditions in favour of the participants.

Due to the Sars-Cov-2 pandemic, SGMUN can consider a reimbursement of the fee upon request of a participant unable to attend the Conference due to an infection. SGMUN reserves the right to decide on an individual basis.

8. Legal domicile 

Place of jurisdiction for any and all legal disputes arising from, or in context with this contract is the Canton of St. Gallen, law permitting. 

Substantive Swiss law is applicable exclusively. 

9. Escape clause 

The club St. Gallen Model United Nations may change ToS at any time. These changes will be communicated to participants. The currently binding ToS are available at https://conf.stgallenmun.ch/termsofservice.

10. Closing provisions 

Should any points in these Terms of service be invalid the validity of any other points remains unaffected.
